Terms & Conditions

​Welcome to the website of Momentis Business Design LLC ("Momentis," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website and professional consulting services. By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Scope of Services

Momentis Business Design LLC provides integrated business consulting across four primary pillars:

  • Visual & Brand Experience: Signage, spatial layout, and brand consistency.

  • Operational Process Optimization: Streamlining workflows and internal systems.

  • Customer Journey & Experience (CX): Friction point identification and customer flow enhancement.

  • Applied Technology & Data Analytics: Utilization of AI and data for evidence-based decision-making.

Specific project deliverables are governed by a signed Master Services Agreement (MSA) and a project-specific Statement of Work (SOW).

2. Intellectual Property

  • Consultant Property: Momentis retains all rights to its pre-existing intellectual property, including proprietary methodologies, ITIL-based analytical frameworks, and templates used during the performance of services.

  • Client Deliverables: Upon full payment, the Client owns the final work product specifically created for them (e.g., "The Clarity Roadmap" reports or custom process maps).

3. Technology, Data, and Analytics

We utilize advanced technology to analyze business patterns, such as customer flow and dwell times.

  • Privacy Standards: We do not record audio or utilize facial recognition technology.

  • Additional Disclosures: Any engagement involving the collection of customer data or the use of on-site analytical devices will require the execution of a separate Digital Processing Agreement (DPA) or specific Customer Consent Forms provided by Momentis. The Client is responsible for ensuring on-site notices comply with local regulations.

4. Marketing and Case Studies

We take pride in the transformation of our clients’ businesses and may use the results of our work for the following purposes:

  • Case Studies: We may use anonymized project results and data for internal analysis and the creation of professional case studies.

  • Marketing & Testimonials: With your express permission, and subject to a separate Marketing Disclosure Agreement, we may feature your business logo, written or video testimonials, and project-related photography or videography in our promotional materials, website, or social media.

5. Commercial Terms

  • Payment: Standard engagements require a 50% upfront investment. Unless otherwise stated in an SOW, undisputed invoices are due within fifteen (15) days of receipt.

  • Cancellations: Either party may terminate an ongoing engagement with thirty (30) days' written notice, subject to the terms of the MSA.

6. Limitation of Liability

To the maximum extent permitted by law, the total liability of Momentis Business Design LLC for any claims arising out of the services shall not exceed the total fees paid by the Client under the specific SOW from which the liability arose. We are not liable for indirect, incidental, or consequential damages.

7. Governing Law

These Terms and any disputes arising from them shall be governed by the laws of the State of Washington. Any legal action shall be filed in the courts located in Thurston County, Washington.
